LAKELAND HOMEQUEST
The Contract and 'small print'
- Lakeland
Homequest will begin its property search for you, the
client, once we have received:
- signed acceptance of the contract
terms stated below, and
- the registration fee in full
- Should
Lakeland Homequest feel your criteria is not feasible
to produce an initial report, we will discuss the options with
you and guarantee to refund your registration fee (less
necessary disbursements) if it is not in your interests to
proceed further.
- Otherwise, the contract period will be
until:
- Six months has elapsed from date of
contract commencement
- A minimum of twelve properties have
been introduced and reported on.
- Purchase of a property by you, the
client, to the point of exchange of contracts
- Either party gives notice to cease
providing the service
- The contract remains valid for any
property introduced by us either directly or from particulars
received from an Estate Agent with whom we have regular
contact.
- Following expiry or termination of the
contract, any property previously introduced by us and
progressed by you within one year of the agreement cessation
shall be deemed to still fall within our contract terms, and
you will be fully liable for the fees as stated below.
- Should the contract be terminated by
you, the client, prior to normal expiry or cessation and
without a property being taken up, we are entitled to charge,
and you agree to pay, all reasonable expenses and costs
incurred on your behalf for the services stated up to the date
of termination.
- You, the client, agree to pay either
(1)
£350 as registration fee upon returning this
contract, plus 1% of the purchase price, capped at £5000
or
(2)
£1000 registration fee plus £2000 final
fixed fee,
on any property
introduced by us either directly or indirectly, payable at the
point of exchange of contracts on said property.
- The registration fee applies per
contract period, as mentioned in (3) above and fees paid
beyond the initial contract period can be deducted from the
final payment if the variable payment option mentioned in
(7.1) above is chosen.
- Details of any properties, valuations,
reports, and other information provided by
Lakeland
Homequest are purely for
your guidance and supplied in good faith. You, the client,
must satisfy yourselves as to the accuracy and correctness of
any details provided by us, and you are strongly recommended
to seek legal or other advice before progressing with any
property we introduce either directly or indirectly. The
service we provide is not, nor is it intended to be, a
substitute for legal or other professional advice in relation
to any property, and we can accept no liability for any
defects in legal title or in the fabric or structure of any
property.
- The services supplied by
Lakeland Homequest are
subject to the above terms and conditions and unless otherwise
expressly agreed in writing shall comprise the whole agreement
between you, the client, and
Lakeland Homequest.
I/we
agree to the contents of this contract as mentioned in (1) to
(10) above, and wish to engage
Lakeland Homequest to act on my/our behalf in a property
search. I/We enclose a cheque for £350/£1000 made payable to
Lakeland Prospects Ltd.
